In Idaho, we’ve had some of the more lenient laws regarding the use of devices while driving. We’ve been able to talk on our phones while driving without issues for years, while other states have had a hands-free law since 2008. With the introduction of a new law, it can sometimes be confusing to understand what you can and cannot do. Below, we at Astro Bail Bonds have outlined the basics of the law to help give you a better understanding and keep you out of trouble.
Under this new Hands-free driving law in Idaho, it forbids you from doing exactly what it sounds like: touching your phone. In the past we were allowed to hold the device while making phone calls, but no longer. You weren’t able to text and drive, but you used to be permitted to change the music and hold your phone. With the new law in place, you’ll have to pull over to perform those actions. You can’t be holding your device in any way while driving. Also new is the fact that you can’t use it even when sitting at a stop light.
The bill was passed in February and went into place on July 1st. Luckily, the law will not be enforced to the full extent until the end of December. Between July 1st and December 31st, warnings will be given out instead of tickets. This will give drivers a little buffer period to completely figure out the new law without being given tickets. Starting January 1st of 2021, tickets will be given out for an offense of the hands-free law.
The state has already established the punishments to be given for violating the new hands-free law. For your first offense, you will be given a $75 ticket. For the second, they double the fine and it comes out to $150. If you receive a third offense they double the fine yet again to make for a $300 ticket, and the possibility of a 90 day license suspension. The second and third offenses are only enforced if the secondary tickets are received within three years of the first ticket.
